STATUS : AS OF 2/20, BILL HAS ADVANCED TO THE SENATE COMMERCE & HUMAN RESOURCES COMMITTEE, HEARING DATE TBD.
This legislation creates a unified and singular definition for agricultural buildings across all local jurisdictions. You can read full bill text HERE.
Background: More frequently, production ag producers are faced with permitting or taxation hurdles when it comes to subjective views on whether a structure will be designated as ‘agricultural’. This bills carves out specifically defined types of buildings, as well as what they do not include. Additionally this bill includes language that does not allow for counties or local government entities to alter, amend, deny, limit or narrow the exemption, including for size, distance, or requirement of sprinklers systems.
Why is this important to cattle producers in Idaho?
Agriculture producers, including livestock operators, depend on use of a variety of structures to support individual needs. Cattle producers may have various livestock sheds, equipment housing, feed silos, or other style storage and maintenance structures. These needs may vary from one operation to the next, but shouldn’t have to undergo subjective determination dependent on county or inspector as to their agricultural use.
Does ICA support this proposed bill?
ICA is supportive of simplified language in statute that removes burden from cattle producers, in an effort to support further viability of ranches in Idaho.
